Shop Regulations
Below you will find the rules regarding the use of our store, placing orders, and your rights as a consumer.
We care about consumer rights. Provisions of agreements that are less favorable to the consumer than those contained in the Consumer Rights Act are invalid. Any doubts should be interpreted in favor of the consumer.
1. General Provisions
1.1. The Online Store available at wallyboards.eu is operated by Satto Media Sp. z o.o., with its registered office at ul. Owsiana 62, 40-780 Katowice, Poland, entered into the Register of Entrepreneurs kept by the District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register, under KRS number 0001142702, NIP (VAT ID) 6343050029, REGON 540531914, with a share capital of PLN 10,000.00, e-mail address: info@wallyboards.eu, contact telephone number: +48 32 720 94 75.
1.2. These Regulations are addressed to both consumers and entrepreneurs using the Online Store, unless a given provision of the Regulations states otherwise.
1.3. The administrator of personal data processed in the Online Store in connection with the implementation of the provisions of these Regulations is the Seller. Personal data is processed for the purposes, for the period, and based on the grounds and principles indicated in the privacy policy published on the Online Store website.
1.4. Definitions:
1.4.1. BUSINESS DAY – one day from Monday to Friday, excluding public holidays in Poland.
1.4.2. REGISTRATION FORM – a form available in the Online Store that allows for the creation of an Account.
1.4.3. ORDER FORM – an Electronic Service, an interactive form available in the Online Store allowing for the placement of an Order, in particular by adding Products to an electronic basket and defining the terms of the Sales Agreement, including the method of delivery and payment.
1.4.4. CUSTOMER – (1) a natural person with full capacity to perform acts in law; (2) a legal person; or (3) an organizational unit without legal personality, to which the law grants legal capacity; - which has concluded or intends to conclude a Sales Agreement with the Seller.
1.4.5. CIVIL CODE – the Civil Code Act of April 23, 1964 (Journal of Laws 1964 No. 16, item 93, as amended).
1.4.6. ACCOUNT – Electronic Service, a collection of resources in the Service Provider's ICT system, marked with an individual name (login) and password, where data provided by the Service Recipient and information about their Orders are collected.
1.4.7. NEWSLETTER – Electronic Service, an electronic distribution service providing information about Products, news, and promotions.
1.4.8. PRODUCT – a movable item available in the Online Store which is the subject of the Sales Agreement.
1.4.9. REGULATIONS – these regulations of the Online Store.
1.4.10. ONLINE STORE - the Service Provider's online store available at: wallyboards.eu.
1.4.11. SELLER; SERVICE PROVIDER – Satto Media Sp. z o.o. (full details as per point 1.1).
1.4.12. SALES AGREEMENT – a Product sales agreement concluded between the Customer and the Seller via the Online Store.
1.4.13. ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Online Store.
2. Electronic Services in the Online Store
2.1. The following Electronic Services are available: Account, Order Form, and Newsletter.
2.1.1. Account – use of the Account is free of charge and for an indefinite period. The Service Recipient may delete the Account at any time without giving a reason.
2.1.2. Order Form – use of the Order Form begins when the Customer adds the first Product to the electronic basket. The service is free and one-off.
2.2. Technical requirements: (1) device with Internet access; (2) active e-mail; (3) updated web browser; (4) recommended resolution: 1024x768; (5) Cookies and Javascript enabled.
3. Terms of Concluding a Sales Agreement
3.1. The conclusion of the Sales Agreement occurs after the Customer places an Order via the Order Form.
3.2. The Product price shown on the website is given in Euro (EUR) (or other currency if selected) and includes taxes. The Customer is informed of the total price, including taxes and delivery costs, during the ordering process.
3.3. After placing an Order, the Seller immediately confirms its receipt and accepts the Order for execution via e-mail. At this moment, the Sales Agreement is concluded.
4. Payment Methods and Terms
4.1. The Seller provides various payment methods, including: (1) Payment on delivery (selected regions); (2) Bank transfer; (3) Electronic payments via Przelewy24, imoje, or PayPal.
4.2. Payment deadline: For pre-payments, the Customer is obliged to pay within 7 calendar days of concluding the Agreement. For "Cash on Delivery," payment is made upon receipt.
5. Delivery and Collection
5.1. Delivery is available within the European Union (excluding Greece and Malta).
5.2. Delivery is paid unless stated otherwise in the Sales Agreement.
5.3. The delivery time is up to 30 Business Days, unless a shorter period is specified in the Product description. For international shipments, it is usually production time + 2-5 business days.
6. Complaint Procedure
6.1. The Seller is obliged to deliver Products free of defects. Liability for defects (Statutory Warranty) is governed by the Polish Civil Code and the Consumer Rights Act.
6.2. Complaints can be submitted in writing (ul. Owsiana 62, 40-780 Katowice, Poland) or via e-mail: info@wallyboards.eu.
6.3. The Seller will respond to the complaint within 14 calendar days.
7. Out-of-Court Dispute Resolution
7.1. Consumers may use out-of-court methods for resolving complaints and pursuing claims, including the EU ODR platform available at: http://ec.europa.eu/consumers/odr.
8. Right of Withdrawal
8.1. A consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving any reason.
8.2. Important: The right to withdraw from a distance contract is not granted to the consumer in respect of contracts where the subject of the service is a **non-prefabricated Product, manufactured according to the consumer's specifications** or serving to satisfy their individual needs (e.g., customized boards, wallpapers cut to size).
8.3. In case of withdrawal, the consumer bears the direct costs of returning the Product.
9. Provisions Concerning Entrepreneurs
9.1. This point applies only to Customers who are not consumers. For such Customers, the Seller's liability under the statutory warranty is excluded.
9.2. Disputes between the Seller and an Entrepreneur shall be submitted to the court having jurisdiction over the Seller's seat.
10. Product Reviews
10.1. The Seller allows Customers to post reviews. The Seller verifies that reviews come from Customers who actually purchased the Product by sending individual links or verifying order numbers.
11. Final Provisions
11.1. Agreements are concluded in English (or Polish depending on the version).
11.2. In matters not covered by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
